Denver Pool Maintenance
These Terms & Conditions ("Terms") govern the provision of pool maintenance, repair, and related services by Denver Pool Maintenance ("Company," "we," "our," or "us") to the customer ("Client," "you," or "your"). By scheduling or receiving services, you agree to be bound by these Terms.
1. Scope of Services
We provide professional swimming pool and spa services, which may include routine maintenance, cleaning, water testing and chemical balancing, equipment inspection, repairs, upgrades, openings, closings/winterization, and related services as agreed in writing or through an approved service plan.
Services are limited to those specifically described in your service agreement, estimate, or invoice. Any additional work requires prior approval and may incur additional charges.
2. Service Schedules & Access
- Service visits are scheduled based on route availability, weather, and seasonal demand.
- You agree to provide safe, unobstructed access to the pool, equipment, water, electricity, and gates on scheduled service days.
- Missed services due to lack of access, locked gates, pets, or unsafe conditions may be billed.
3. Weather & Seasonal Conditions
- Weather conditions (rain, wind, freezing temperatures, wildfires, or local restrictions) may delay or modify services.
- We are not responsible for conditions beyond our control, including but not limited to weather-related delays or damage.
4. Chemicals & Water Quality
- Chemical use and water balancing are based on industry standards and test results at the time of service.
- Water chemistry can change rapidly due to weather, usage, landscaping, and source water conditions. We do not guarantee constant chemical levels between visits.
- Client acknowledges that algae growth, staining, or cloudiness may occur due to factors beyond our control.
5. Equipment Condition & Repairs
- We inspect equipment visually and operationally during service visits but do not guarantee detection of all defects.
- Repairs or replacements will be recommended when issues are identified; work proceeds only with Client approval.
- We are not responsible for failures caused by aging equipment, manufacturer defects, improper installation by others, or pre-existing conditions.
6. Client Responsibilities
You agree to:
- Maintain proper water level between service visits unless otherwise agreed.
- Secure pets and remove hazards before service.
- Inform us of any known leaks, equipment issues, or changes to pool operation.
- Maintain required utilities (water, power, gas) for proper service delivery.
7. Pricing, Fees & Payment
- Pricing is based on the selected service plan, scope of work, pool size, equipment, and site conditions.
- Invoices are due upon receipt unless otherwise stated in writing.
- Late payments may be subject to service suspension and/or late fees.
- Returned payments may incur additional processing fees.
8. Cancellations & Termination
- Either party may terminate ongoing service with written notice as outlined in the service agreement.
- Short-notice cancellations or repeated missed appointments may be billed.
- Outstanding balances remain payable upon termination.
9. Property Damage & Liability
- We take reasonable care while performing services. Minor wear (e.g., fading, aging, brittle components) is considered normal and not damage.
- We are not responsible for damage to hidden, underground, or pre-existing defective components.
- Client agrees to notify us of any concerns within 48 hours of service.
10. Safety
- We reserve the right to refuse or stop service if conditions are unsafe.
- Children and pets must be kept away from the work area during service visits.
11. Warranties & Limitations
- Labor warranties, if any, are limited to the terms stated on the invoice.
- Manufacturer warranties apply to parts and equipment supplied.
- To the fullest extent permitted by law, we disclaim implied warranties beyond those expressly stated.
12. Limitation of Liability
To the maximum extent permitted by law, Denver Pool Maintenance shall not be liable for indirect, incidental, or consequential damages, including loss of use, water, chemicals, or energy.
13. Indemnification
Client agrees to indemnify and hold harmless Denver Pool Maintenance from claims arising from unsafe conditions, undisclosed defects, or Client’s failure to meet responsibilities outlined herein.
14. Compliance With Laws
Services are provided in accordance with applicable local, state, and federal regulations. Client is responsible for HOA approvals or permits unless otherwise agreed.
15. Changes to Terms
We may update these Terms from time to time. Continued use of services constitutes acceptance of the updated Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado.
17. Acceptance
By scheduling, approving, or receiving services, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
